Definitions & Interpretation
- “Member” means an authorized user of the Platform and/or the Services.
- “Referrer” means the one who refers the job.
- “Candidates” the one who is being referred.
- “Intellectual Property” means all copyright, patents, utility innovations, trademarks and service marks, geographical indications, domain names, layout design rights, registered designs, design rights, database rights, trade or business names, rights protecting trade secrets and confidential information, rights protecting goodwill and reputation, and all other similar or corresponding proprietary rights and all applications for the same, whether presently existing or created in the future, anywhere in the world, whether registered or not, and all benefits, privileges, rights to sue, recover damages and obtain relief or other remedies for any past, current or future infringement, misappropriation or violation of any of the foregoing rights.
- “Password” refers to the valid password that a Member who has an account with www.JobsCo.com may use in conjunction with the Username to access the relevant Platform and/or Services.
- “Personal Data” means data, whether true or not, that can be used to identify, contact or locate you. Personal Data can include your name, e-mail address, billing address, shipping address, phone number and credit card information.
- “Services” means services, information and functions made available on our website.
- “Username” refers to the unique login identification name or code which identifies a Member who has an account with www.JobsCo.com.
- “you” and “your” refer to the individuals over the age of 18 or otherwise under the supervision of a parent or legal guardian.
- “Account” refers to your personal information logged in together with your Username and Password.
- “Accrual of affiliate funds” means the Non-profit, Club, Group or Charity receiving funds from www.JobsCo.com.
Any reference in these Terms & Conditions to any provision of a statute shall be construed as a reference to that provision as amended, re-enacted or extended at the relevant time. In these Terms & Conditions of Sale, whenever the words “include”, “includes” or “including” are used, they will be deemed to be followed by the words “without limitation”. Unless expressly indicated otherwise, all references to a number of days mean calendar days, and the words “month” or “monthly” as well as all references to a number of months means calendar months. Clause headings are inserted for convenience only and shall not affect the interpretation of these Terms & Conditions of Sale. In the event of a conflict or inconsistency between any two or more provisions under these Terms & Conditions of Sale, whether such provisions are contained in the same or different documents, such conflict or inconsistency shall be resolved in favor of www.JobsCo.com and the provision which is more favourable to www.JobsCo.com shall prevail.
To access certain features of the Service you must register for an account. When you register for an account, you may be required to provide us with some information about yourself (such as your e-mail address or other contact information). You agree that the information you provide to us is and will be accurate and up-to-date at all times. When you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. Using Our System to post a job.
Our system have two (2) types of job posting being a “Pay per Posting” job post and “Recruitment model”. The mechanism shall be in accordance to the terms stated below:
Pay per Posting
You would need to purchase credit if you have not purchased any credits before, you may do so by paying with credit card or direct online banking.
Once you have credits, you may post a job by putting in all the job description you need. Each credit entitles you to one (1) job post only. Please be sure to preview the job post before you post it as you would not be able to edit it once it is posted.
If you opt for the “Performance incentive” program, our customer service will contact you for payment details.
Referral Program is a recruitment method to identify potential candidates from the social networks. This referral program encourages users to select and recruit the suitable candidates for the company as applicants and/or referrers.
This Terms and Conditions is binding between www.JobsCo.com “We” and “You” as our dear Member or User.
The Client acknowledges that:
A total fee of percentage of Annual Basic Salary is charged, (based on range of the agreed percentage) non-inclusive of bonuses and/or allowances given to the candidates.
A fee will be payable (30%) for any Engagement that occurs after 14 days in time frame of hiring date and the full fee is payable in respect of each Represented Resource Engagement; JobsCo gets balance of (70%) of the total fee after 90 days respectively.
Any print, internet or other advertising will be agreed specifically with the Client prior to placement to the appropriate media and will be on-charged at the market rates to the Client.
Out of pocket expenses agreed upon during the recruitment process such as travel, accommodation, video conferencing or substantial overseas phone calls and similar, will be on-charged to the Client at cost.
You agree that any information or data you post or cause to appear on our website in connection with the Services is accurate and agree to take sole responsibility for such information and data.
You agree not to reverse engineer, decompile, disassemble, copy or otherwise derive the source code of our system for any reason. You may not rent, sell, or sublicense our System without our express written consent.
We are using 3 types of payment modes and you hereby agree to read and comply their terms and conditions:
Braintree payment which is a PCI compliant online credit card saving payment options, will be used to save the company's credit cards to ensure the referral payments are done automatically. If this fails due to transaction problems (Credit card over limit and etc.) we will be providing payment option b. which is as below.
MOLpay, which is a Malaysian base payment gateway that offers credit card and Direct online banking. The above are for the “Referral program” program, which for “pay per posting” program would be strictly on MOLpay only. The performance incentive part would be all of the above including the c. payment option as below.
Cheque is an option for company to use besides our online banking and credit card modes. Cheque would be strictly for Referral program only.
Participation and Earnings
Your participation in our website and the opportunity to earn and raise taxable funds, is offered at the sole discretion of www.JobsCo.com, and www.JobsCo.com has the right to change or amend this Agreement in whole, or in part at any time, with or without notice.
www.JobsCo.com reserves the right to change and or amend the application for non-profits, clubs and charities seeking funds from www.JobsCo.com.
We reserve the right to create a new or change the existing tiered, as we see fit.
You have acknowledge that We have a mailing list option whose main function is to update shoppers of new Affiliate stores and any timely, relevant information from www.JobsCo.com. eg, contest winners.
We reserve the right, at our sole discretion, to deny service or use of our System to anyone at any time and for any reason. While we use reasonable efforts to keep our System and your account accessible, the Site and/or your account may be unavailable from time to time. You understand and agree that there may be interruptions in service or events, Site access or access to your account due to circumstances both within our control (e.g., routine maintenance) and outside of our control.
You must keep your email, bank account and contact information correct and current. www.JobsCo.com is not responsible for payments applied to the wrong account, or sent to the wrong address if these errors were caused by in accurate email, bank account or contact information provided by you. We will work with you to find solutions to any such issues should they arise.
Third Party Services
We may provide tools through the Service that enable you to export information to third party services, including through use of an API or by linking your account on mailchimp with an account on the third party service.
By using these tools, you agree that we may transfer such User Content and information to the applicable third party service.
Such third party services are not under our control, and we are not responsible for the contents of the third party service or the use of your User Content or information by the third party service.
The Service, including our websites, may also contain links to third-party websites. The linked sites are not under our control, and we are not responsible for the contents of any linked site.
We provide these links as a convenience only, and a link does not imply our endorsement of, sponsorship of, or affiliation with the linked site.
You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any of these third parties services or websites.
We may change the terms of this Agreement at any time by notifying you of such changes in writing or electronically. The changes also will appear in this document, which you can access at any time through the link of this website. You signify that you agree to be bound by such changes by using our Service(s) after changes are made to this Agreement.
Our Services is available only to legal entities and persons who are at least eighteen (18) years old and are otherwise capable of forming legally binding contracts under applicable law.

NOR DO THEY MAKE ANY WARRANTY AS TO (A) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE,
OR (B) THE ACCURACY, COMPLETENESS OR RELIABILITY OF (I) THE CONTENT ON THE SITE,

WHETHER OR NOT THE WWW.JOBSCO.COM ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE WHERE SUCH DAMAGES RESULT FROM:

(ii) ANY PURCHASE OF A THIRD PARTY PRODUCT OR SERVICE BASED ON INFORMATION CONTAINED IN THE WWW.JOBSCO.COM SERVICE, INCLUDING THE AVAILABILITY OF A COUPON.
YOU SPECIFICALLY ACKNOWLEDGE THAT THE WWW.JOBSCO.COM ENTITIES ARE NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
FURTHER, THE WWW.JOBSCO.COM ENTITIES WILL HAVE NO LIABILITY TO YOU OR TO ANY THIRD PARTY FOR ANY THIRD-PARTY CONTENT UPLOADED ONTO OR DOWNLOADED FROM THE SITE OR THROUGH THE SERVICE.
WARRANTY AND REPRESENTATION

OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OR ACCURACY OF ADVERTISEMENTS FOR ANY PRODUCTS OR SERVICES OFFERED OR PROVIDED BY THE RETAIL STORES IN CONJUNCTION WITH THE OPPORTUNITY TO EARN AFFILIATE FEES FOR NON-PROFITS,
CLUBS AND CHARITIES. IN ADDITION, WWW.JOBSCO.COM DOES NOT WARRANT THAT ACCESS TO THIS SITE OR USE OF ITS APPLICATIONS WILL BE UNINTERRUPTED OR ERROR-FREE.
ADDITIONALLY, WWW.JOBSCO.COM DOES NOT WARRANT, GUARANTEE,
OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OR ACCURACY OF ADVERTISEMENTS FOR ANY PRODUCTS OR SERVICES OFFERED OR PROVIDED BY THE RETAIL STORES IN CONJUNCTION WITH THE OPPORTUNITY TO EARN AFFILIATE FEES FOR NON-PROFITS, CLUBS AND CHARITIES.
This Agreement may be terminated only
Your substantial breach of any material provisions Agreement provided due notice has been given to you by us of the alleged breach and such has not cured the breach within 3 days thereof.
Termination without notice where the breach is not remediable.
You may request to terminate this Agreement by notifying www.JobsCo.com.
In all instances, Termination will result to removal of your account registration.
If any provision of this Agreement is adjudged by a court to be void or unenforceable such provision shall no way affect any other provision of this Agreement, the application of the provision in any other circumstances or the validity or enforceability of this Agreement and such provision shall be curtailed and limited only to the extent necessary to bring it within legal requirement.
